Terms of Service

By using engagelayer.io, you agree to these Terms. They define what we provide, what you provide, and what happens when something goes wrong. Plain language, no surprises.
1. What we provide
A platform that lets you deploy an AI assistant on your B2B website, configure its voice and content, capture qualified leads, and route them to your sales tools. Our team handles setup and onboarding for every plan.
2. What you provide
A website where the assistant runs, public-facing business content (FAQs, brochures, service descriptions), and accurate billing information.
3. Acceptable use
You agree not to use the platform for: spam or unsolicited mass messaging, illegal content, content that violates third-party rights, AI prompt-injection attacks against other users, attempts to extract our internal model behaviour, or any activity that violates EU consumer protection or data privacy law.
4. Sensitive data restriction
You commit to not loading sensitive data — internal pricing, contracts, customer lists, employee records, or unreleased product specs — into the assistant. The platform is designed for public-facing customer engagement. Sensitive data exposure caused by you is your responsibility.
5. Subscriptions & cancellation
Subscriptions auto-renew monthly until cancelled. You can cancel anytime — service continues to the end of the paid period, then stops. No refunds for partial months. Setup fees are non-refundable once work has started.
6. AI usage costs
Each plan includes a fixed monthly conversation allowance, and the AI compute needed to deliver it is included in your subscription — there is no separate AI bill for you to manage. If your traffic consistently exceeds your plan, we work with you on moving to a plan that matches it.
7. Service availability
We target 99.5% monthly uptime for the platform. If we miss it, you receive service credit toward the next month. Planned maintenance is announced 5 days in advance.
8. Liability
Our liability is limited to the amount you paid us in the 12 months preceding the incident. We are not liable for indirect or consequential damages, lost profits, or actions taken by your visitors based on assistant responses.
9. Termination
We can terminate accounts that violate these Terms with 30 days notice (immediately for severe violations). On termination, you have 30 days to export your data before it is permanently deleted.
10. Changes
We can update these Terms with 30 days notice by email. Material changes (data handling, pricing) require your active acceptance. Minor changes (typo fixes, restructuring) take effect automatically.
11. Governing law
These Terms are governed by Romanian law and applicable EU regulations, as the service is provided by PRO AGENCY EUROPE SRL registered in Bucharest, Romania. Disputes are resolved in good faith first; otherwise they go to the competent courts of Bucharest, Romania.
